Terms of Service

These Terms of Service ("Terms") govern your access to and use of Emulation Ninja websites, applications, and related services (the "Services") offered by 0845915 B.C. LTD. (British Columbia incorporation number BC0845915) ("we," "our," or "us"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility and accounts
You must be able to form a binding contract in your jurisdiction to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
You agree to provide accurate registration information and keep it up to date where the product allows.
License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use (or as otherwise permitted by a separate agreement with us). Except as allowed by applicable law, you may not copy, modify, distribute, sell, or lease the Services or reverse engineer or attempt to extract source code from our software.
Acceptable use
You agree not to:
- Use the Services in violation of law or third-party rights;
- Interfere with or disrupt the Services, servers, or networks;
- Attempt to gain unauthorized access to systems, data, or accounts;
- Use the Services to distribute malware, spam, or harmful content;
- Scrape or harvest data from the Services at scale without our written permission;
- Bypass or circumvent technical limits or security measures we employ.
You are responsible for your use of emulators and game files in compliance with applicable law and any rights holders. The Services are tools; we do not grant you rights in third-party games or software.
Your content
You may upload or sync information through the Services. You retain ownership of your content. To operate the Services, you grant us a worldwide license to host, process, transmit, and display your content only as reasonably necessary to provide, secure, and improve the Services for you — consistent with our Privacy Policy.
Third-party services
The Services may integrate with or link to third-party sites, APIs, or stores. Those third parties are not controlled by us; their terms and privacy practices apply to you when you use them.
Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, our disclaimers apply only to the extent permitted.
Limitation of liability
To the fullest extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability for claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid us for the Services in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100), if you have not paid us fees.
These limitations apply even if remedies fail of their essential purpose. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum permitted.
Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless 0845915 B.C. LTD. and its affiliates, officers, and employees from third-party claims, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if we must do so for legal or security reasons, or if we discontinue the Services. Provisions that by their nature should survive termination will survive—including intellectual property, disclaimers, limitation of liability, indemnity, and governing law.
Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, excluding conflict-of-law rules, except that consumer protections in your country of residence may apply where mandatory law requires.
Subject to mandatory consumer venue rules, you agree that the courts in the courts of the Province of British Columbia sitting in Vancouver, Canada have exclusive jurisdiction over disputes arising from these Terms or the Services, unless applicable law requires otherwise.
Changes
We may modify these Terms from time to time by posting an updated version on this page and updating the effective date. If a change is material, we will provide additional notice where required by law. Your continued use after the effective date of changes constitutes acceptance of the updated Terms.
